Definition of personal data
Personal data means any information of any type and regardless of its form, relating to an identified or identifiable natural person (data subject). An identifiable person is someone who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural, or social identity.
Collection and processing
MARKET ACCESS, within the scope described above, collects and processes the personal data required for the provision and operation of the service provided to the Customer, such as Name, date of birth, telephone number, and e-mail address. The User’s data is collected in writing through the web site, on paper, or the mobile device, according to the latter’s consent. The personal data collected are processed on a computer and in compliance with the Portuguese legislation on the protection of personal data.
Purpose of the processing
The data collected and processed as described above are intended for the operation and provision of services to MARKET ACCESS Customers, namely for the purposes of contacts and to inform Customers on available services. By adhering, the User authorizes MARKET ACCESS to proceed with the processing of his/her personal data, fully consenting to the processing of his/her personal data regarding identification, contact, and transaction data. The collected and processed data, when authorized by the User, will be used to keep the latter informed of the services provided by Market Access. In no event shall the data collected be used for any purpose other than that for which the data subject has consented, with the exception of disclosure that may become necessary for compliance with a court order or a competent authority under the terms of the legislation in force.
MARKET ACCESS guarantees adequate levels of security and protection of personal data. We have, therefore, adopted a number of technical and organizational security measures to protect all personal data that are provided against their disclosure, loss, misuse, alteration, processing, and unauthorized access, and against any other form of unlawful processing. Consequently, all the personal data communicated by the User are securely stored.
Where there is no specific legal requirement, data shall be retained and stored only for the minimum period necessary for the purposes for which it was collected or subsequent processing or for the period of time authorized by the National Data Protection Authorities, after which time they will be deleted. The data retention time period shall not exceed 730 days after it was last used. In the event of a request by the user, the data will be immediately destroyed within a maximum period of 48 hours, as well as in cases of termination of the contract associated with the customer card.
Communication of data to third parties
MARKET ACCESS may use third parties for the provision of certain services and this may result in these entities accessing the User’s personal data. When this happens, MARKET ACCESS takes the appropriate precautions in order to ensure that the entities that have access to the data are reputable and offer the highest guarantees of security, and this will be duly defined and safeguarded in a contract to be signed between Market Access and each of these third parties. MARKET ACCESS ensures, at all times, the possibility of the User objecting to the communication of data to third parties.
Right of access to personal data
In accordance with the Data Protection Act, the User may at any time, change, rectify, or delete his or her personal data by one of the available forms: website, via the private management area, or by writing to the Market Access address (Rua da Lionesa, Centro Empresarial Lionesa, C6, 4465-671 Leça do Balio – Portugal), attaching a copy of his or her identification. This right to object is free of charge. The Customer may, at any time:
• Withdraw consent regarding the processing of personal data. The withdrawal of the consent will not jeopardize the lawfulness of the processing based on the consent previously granted.
• Object to the continuation of the processing of Personal Data;
• Request access, rectification, and portability of Personal Data;
• Request deletion, including the Right to Erasure, except when the processing is necessary for the fulfillment of a legal obligation;
• Submit a complaint to the CNPD – Portuguese Data Protection Authority.
This right to object is free of charge.
